End-User License Agreement (EULA) of “Cut the Finger”
This End-User License Agreement (“EULA”) is a legal agreement between you and Multinetz.com or Multinetz.
This EULA agreement governs your acquisition and use of our “Cut the Finger” software (“Software”) directly from Multinetz.com or Multinetz or indirectly through a Multinetz.com or Multinetz authorized reseller or distributor (a “Reseller” like Amazon App Store, Google Play or ITunes Apple Store).
Please read this EULA agreement carefully before completing the installation process and using the “Cut the Finger” software. It provides a license to use the “Cut the Finger” software and contains warranty information and liability disclaimers.
Parties This Agreement is between you and “Cut the Finger” only, and not Amazon, Google or Apple. Notwithstanding the foregoing, you acknowledge that Amazon, Google or Apple and its subsidiaries are third party beneficiaries of this Agreement and Amazon, Google or Apple has the right to enforce this Agreement against you. “Cut The Finger”, not Amazon, Google or Apple, is solely responsible for the “Cut The Finger” App and its content.
If you register for a free trial of the “Cut The Finger” software, this EULA agreement will also govern that trial. By clicking “accept” or installing and/or using the “Cut The Finger” software, you are confirming your acceptance of the Software and agreeing to become bound by the terms of this EULA agreement.
If you are entering into this EULA agreement on behalf of a company or other legal entity, you represent that you have the authority to bind such entity and its affiliates to these terms and conditions. If you do not have such authority or if you do not agree with the terms and conditions of this EULA agreement, do not install or use the Software, and you must not accept this EULA agreement.
This EULA agreement shall apply only to the Software supplied by Multinetz.com or Multinetz herewith regardless of whether other software is referred to or described herein. The terms also apply to any Multinetz.com or Multinetz updates, supplements, Internet-based services, and support services for the Software, unless other terms accompany those items on delivery. If so, those terms apply.
Privacy “Cut The Finger” may collect and use information about your usage of the “Cut The Finger” App, including certain types of information from and about your device. “Cut The Finger” may use this information, as long as it is in a form that does not personally identify you, to measure the use and performance of the “Cut The Finger” App.
License Grant
Limited License “Cut The Finger” grants you a limited, non-exclusive, non-transferable, revocable license to use the “Cut The Finger” App for your personal, non-commercial purposes. You may only use the “Cut The Finger” App on Amazon Kindle fire or devices or Google Android devices or Apple devices that you own or control and as permitted by the App Stores(Amazon,Google,Apple) Terms of Service.
Multinetz.com or Multinetz hereby grants you a personal, non-transferable, non-exclusive licence to use the “Cut The Finger” software on your devices in accordance with the terms of this EULA agreement.
You are permitted to load the “Cut The Finger” software (for example a PC, laptop, mobile or tablet) under your control. You are responsible for ensuring your device meets the minimum requirements of the “Cut The Finger” software.
You are not permitted to:
Edit, alter, modify, adapt, translate or otherwise change the whole or any part of the Software nor permit the whole or any part of the Software to be combined with or become incorporated in any other software, nor decompile, disassemble or reverse engineer the Software or attempt to do any such things
Reproduce, copy, distribute, resell or otherwise use the Software for any commercial purpose
Allow any third party to use the Software on behalf of or for the benefit of any third party
Use the Software in any way which breaches any applicable local, national or international law
use the Software for any purpose that Multinetz.com or Multinetz considers is a breach of this EULA agreement
Intellectual Property and Ownership
Multinetz.com or Multinetz shall at all times retain ownership of the Software as originally downloaded by you and all subsequent downloads of the Software by you. The Software (and the copyright, and other intellectual property rights of whatever nature in the Software, including any modifications made thereto) are and shall remain the property of Multinetz.com or Multinetz.
Multinetz.com or Multinetz reserves the right to grant licences to use the Software to third parties.
Termination
This EULA agreement is effective from the date you first use the Software and shall continue until terminated. You may terminate it at any time upon written notice to Multinetz.com or Multinetz.
It will also terminate immediately if you fail to comply with any term of this EULA agreement. Upon such termination, the licenses granted by this EULA agreement will immediately terminate and you agree to stop all access and use of the Software. The provisions that by their nature continue and survive will survive any termination of this EULA agreement.
Governing Law
Product Claims “Cut The Finger”, not Amazon, Google or Apple, is responsible for addressing any claims by you relating to the “Cut The Finger” App or use of it, including, but not limited to:
(i) any product liability claim; (ii) any claim that the “Cut The Finger” App fails to conform to any applicable legal or regulatory requirement; and (iii) any claim arising under consumer protection or similar legislation. Nothing in this Agreement shall be deemed an admission that you may have such claims.
Third Party Intellectual Property Claims “Cut The Finger” shall not be obligated to indemnify or defend you with respect to any third party claim arising out or relating to the “Cut The Finger” App. To the extent “Cut The Finger” is required to provide indemnification by applicable law, “Cut The Finger”, not Amazon, Google or Apple, shall be solely responsible for the investigation, defense, settlement and discharge of any claim that the “Cut The Finger” App or your use of it infringes any third party intellectual property right.
This EULA agreement, and any dispute arising out of or in connection with this EULA agreement, shall be governed by and construed in accordance with the laws of CH.
